1. Overview & Acceptance
Welcome to OnKommon ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website, applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
Our Services are provided in exclusive clinical partnership with KPCIRC (Kwatra Precision Cancer Institute & Research Centre), which provides the licensed clinical authority behind our decision-support and care-navigation services.
Important: OnKommon provides decision-support and care-navigation services. Our technology informs; it does not diagnose, prescribe, or replace a doctor.
2. Our Services
OnKommon offers a range of precision-oncology services, including but not limited to:
- Blueprint Care: A flagship decision-report and clinical coordination service.
- Signature: Comprehensive molecular profiling tests (blood and tissue).
- Decipher: Interpretation of existing genomic data.
- Heritage: Hereditary cancer risk testing (germline).
- Clear: Molecular residual disease (MRD) surveillance.
- Sentinel: Continuous monitoring during active treatment.
Each service is designed to support you and your treating physician with actionable clinical intelligence. All clinically consequential decisions are authored and signed by licensed clinicians through our exclusive clinical partner, KPCIRC.
3. Account Registration
To access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update your information as needed.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.
4. Medical Information & Disclaimer
OnKommon provides decision-support and care-navigation services. Our technology informs; it does not diagnose, prescribe, or replace a doctor. Every clinically consequential decision is authored and signed by a licensed clinician through our exclusive clinical partner, KPCIRC.
Critical Disclaimers:
- Our Services are for informational and decision-support purposes only.
- Nothing on our platform constitutes medical advice, diagnosis, or treatment.
- You should always consult a qualified healthcare professional for medical concerns.
- Genomic testing has limits: a "not detected" result does not rule out disease.
- OnKommon is not an emergency service. In an emergency, contact your nearest hospital.
- We do not guarantee that a drug, trial, or therapy will be available, approved, covered, or effective.
Your treating oncologist remains the licensed physician who officially prescribes medication and oversees your medical care. OnKommon supports your care team with intelligence, coordination, and navigation.
5. User Conduct
You agree to use our Services responsibly and lawfully. You will not:
- Use the Services for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to our systems or user data.
- Interfere with the proper functioning of the Services.
- Upload or transmit harmful code, viruses, or malicious content.
- Provide false or misleading information.
- Share your account credentials with unauthorized persons.
We reserve the right to investigate and take appropriate legal action against any user who violates these Terms.
6. Intellectual Property
All content, features, and functionality on our platform — including text, graphics, logos, software, and proprietary algorithms — are the exclusive property of OnKommon or our licensors and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use our Services for your personal or clinical purposes. You may not reproduce, distribute, modify, or create derivative works of our content without our express written consent.
Our proprietary interpretation engine, intelligence layers (CloneTrace™, SynerGx™, PhenoMap™, ImmunoLens™, TrialGraph™, AccessMatch™), and report architecture are trade secrets and may not be reverse-engineered or replicated.
7. Third-Party Services
Our Services integrate with and rely on third-party partners, including:
- KPCIRC: Our exclusive clinical partner providing licensed clinical authority, molecular tumour board reviews, sign-offs, second opinions, genetic counselling, and patient navigation.
- Accredited Laboratory Partners: Providing sequencing and variant calling services.
- Secure Communication Platforms: Enabling coordination and consultation.
We are not responsible for the content, privacy practices, or performance of third-party services. We recommend reviewing their terms and policies when using their services.
8. Limitation of Liability
To the fullest extent permitted by applicable law, OnKommon and its affiliates, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our Services.
Our total liability to you for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you have paid to us for the specific service giving rise to the claim, or INR 1,000, whichever is greater.
Healthcare-Specific Limitation: We do not guarantee that a specific treatment, trial, or drug will be available, approved, covered, or effective. All clinical decisions are made by your treating physician.
Some jurisdictions do not allow the exclusion or limitation of liability for certain damages. In such cases, our liability shall be limited to the greatest extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless OnKommon, its affiliates, partners, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of our Services.
- Your violation of these Terms.
- Your violation of any applicable laws or regulations.
- Your infringement of any third-party rights.
10. Termination
We may suspend or terminate your access to our Services at any time, with or without cause, with or without notice, effective immediately. Cause for termination includes, but is not limited to:
- Violation of these Terms.
- Fraudulent or unlawful activity.
- Request by law enforcement or regulatory authorities.
Upon termination, your right to use our Services will cease immediately. Provisions that by their nature should survive termination (e.g., Medical Disclaimer, Limitation of Liability, Governing Law) shall survive.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms or our Services shall be brought exclusively in the courts of New Delhi, India.
We operate in compliance with India's Digital Personal Data Protection Act, 2023 (DPDPA 2023) and applicable healthcare regulations.
12. Changes to Terms
We may update these Terms from time to time to reflect changes in our practices, technology, or legal requirements. We will notify you of any material changes by posting the updated Terms on our website or through direct communication. The "Last Updated" date at the top of this page indicates when it was last revised.
Your continued use of our Services after the effective date of the updated Terms constitutes your acceptance of the revised Terms.
